01什么是醫(yī)療器械

 

什么是醫(yī)療器械呢？

 

簡(jiǎn)單粗暴的說(shuō)法：醫(yī)院里，除了人和藥，都是醫(yī)療器械。

 

比如醫(yī)生給你看嗓子用的壓舌板，抽血化驗(yàn)的試劑盒；血壓計(jì)、血糖儀；病床、手術(shù)床；拍胸片的X光機(jī)等等，都是醫(yī)療器械。

 

（思宇MedTech提示：我們經(jīng)常說(shuō)的生物醫(yī)藥產(chǎn)業(yè)，包括政策制訂、數(shù)據(jù)測(cè)算等，都含有醫(yī)療器械。但從國(guó)民經(jīng)濟(jì)行業(yè)分類(lèi)代碼來(lái)看，醫(yī)療設(shè)備包含于通用設(shè)備內(nèi)，體現(xiàn)了其制造業(yè)屬性。）

我們需要學(xué)習(xí)定義么？是不是有點(diǎn)咬文嚼字呢？并不是。

 

舉例以下三個(gè)問(wèn)題：

 

1. 給寵物治療用的設(shè)備，算“醫(yī)療器械”么？

 

在我國(guó)，醫(yī)療器械是給人用的；給動(dòng)物用的器械，不在國(guó)家藥監(jiān)局監(jiān)管的醫(yī)療器械范圍內(nèi)。而在美國(guó)，動(dòng)物用醫(yī)療器械也屬于FDA監(jiān)管范圍。

 

2. 康復(fù)用器械，算“醫(yī)療器械”么？

 

事實(shí)上，“康復(fù)輔助器具”和“醫(yī)療器械”是兩個(gè)概念。

 

前者定義為“康復(fù)輔助器具，亦稱(chēng)康復(fù)輔具，是指預(yù)防殘疾，改善、補(bǔ)償、替代人體功能和輔助性治療的產(chǎn)品，包括器具、設(shè)備、儀器、技術(shù)和軟件。”

 

康復(fù)用器械，只有一部分矯形器和一些個(gè)人醫(yī)療輔助器具，屬于醫(yī)療器械。大部分都納入康復(fù)輔具，由民政部監(jiān)督管理。

 

3. 口罩、紗布、隱形眼鏡……算醫(yī)療器械么？

 

隱形眼鏡、體溫計(jì)、醫(yī)用脫脂棉、醫(yī)用脫脂紗布、醫(yī)用衛(wèi)生口罩、避孕套、輪椅等，都屬于醫(yī)療器械。均在監(jiān)管范圍內(nèi)。

不同的國(guó)家，醫(yī)療器械都有相應(yīng)的監(jiān)管部門(mén)和定義，范圍是不大一樣的。

 

02中國(guó)的器械定義

 

中國(guó)的醫(yī)療器械監(jiān)管部門(mén)：

醫(yī)療器械定義：

 

醫(yī)療器械，是指直接或者間接用于人體的儀器、設(shè)備、器具、體外診斷試劑及校準(zhǔn)物、材料以及其他類(lèi)似或者相關(guān)的物品，包括所需要的計(jì)算機(jī)軟件；其效用主要通過(guò)物理等方式獲得，不是通過(guò)藥理學(xué)、免疫學(xué)或者代謝的方式獲得，或者雖然有這些方式參與但是只起輔助作用；其目的是：

 

（一）疾病的診斷、預(yù)防、監(jiān)護(hù)、治療或者緩解；

 

（二）損傷的診斷、監(jiān)護(hù)、治療、緩解或者功能補(bǔ)償；

 

（三）生理結(jié)構(gòu)或者生理過(guò)程的檢驗(yàn)、替代、調(diào)節(jié)或者支持；

 

（四）生命的支持或者維持；

 

（五）妊娠控制；

 

（六）通過(guò)對(duì)來(lái)自人體的樣本進(jìn)行檢查，為醫(yī)療或者診斷目的提供信息。

02美國(guó)的醫(yī)療器械定義

 

美國(guó)的醫(yī)療器械監(jiān)管部門(mén)：

 

U.S. Food&Drug Administration，美國(guó)食品藥品監(jiān)督管理局，簡(jiǎn)稱(chēng)FDA。

醫(yī)療器械（Medical Device）定義：

 

根據(jù)《食品、藥品和化妝品法》第201（h）節(jié)，醫(yī)療器械為：

 

儀器、設(shè)備、器具、機(jī)器、用具、植入物、體外試劑或校準(zhǔn)器，或者其他相似或相關(guān)物品，包含零部件或配件，它是∶

 

記載于正式的國(guó)家處方集，或美國(guó)藥典，或其附錄;

 

疾病的診斷、監(jiān)護(hù)、緩解、治療或預(yù)防，作用于人類(lèi)或其他動(dòng)物；

 

影響人體或其它動(dòng)物身體的結(jié)構(gòu)或功能，并且不是通過(guò)在人體或動(dòng)物體內(nèi)的化學(xué)作用，也不是依靠產(chǎn)生代謝變化來(lái)獲得既定預(yù)期用途。

An instrument, apparatus, implement, machine, contrivance, implant, in vitro reagent, or other similar or related article, including a component part, or accessory which is:

 

recognized in the official National Formulary, or the United States Pharmacopoeia, or any supplement to them,

intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease, in man or other animals, or

intended to affect the structure or any function of the body of man or other animals, and which does not achieve its primary intended purposes through chemical action within or on the body of man or other animals and  which is not dependent upon being metabolized for the achievement of its primary intended purposes. 

 

03歐盟

 

在歐盟銷(xiāo)售的醫(yī)療器械產(chǎn)品需要有CE認(rèn)證（CONFORMITE EUROPEENNE）。其相關(guān)的法規(guī)和定義在歐盟委員會(huì)網(wǎng)站上有。

歐盟對(duì)于醫(yī)療器械、IVD、藥械組合產(chǎn)品有不同的法規(guī)。醫(yī)療器械（Medical Devices，主要是設(shè)備）為Regulation (EU) 2017/745) ；IVD為In-Vitro Diagnostic Devices (Regulation (EU) 2017/746) 。以下是醫(yī)療器械部分。

 

醫(yī)療器械（Medical Device）定義：

 

“醫(yī)療器械”是指制造商打算單獨(dú)或組合用于人類(lèi)用于以下一個(gè)或多個(gè)特定醫(yī)療目的的任何儀器、器具、器具、軟件、植入物、試劑、材料或其他物品：

 

—疾病的診斷、預(yù)防、監(jiān)測(cè)、預(yù)測(cè)、預(yù)后、治療或緩解，

 

—診斷、監(jiān)測(cè)、治療、減輕或賠償傷害或殘疾，

‘medical device’ means any instrument, apparatus, appliance, software, implant, reagent, material or other article intended by the manufacturer to be used, alone or in combination, for human beings for one or more of the following specific medical purposes:

 

—diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of disease,

 

—diagnosis, monitoring, treatment, alleviation of, or compensation for, an injury or disability,

 

—investigation, replacement or modification of the anatomy or of a physiological or pathological process or state,

 

—providing information by means of in vitro examination of specimens derived from the human body, including organ, blood and tissue donations,and which does not achieve its principal intended action by pharmacological, immunological or metabolic means, in or on the human body, but which may be assisted in its function by such means.

 

The following products shall also be deemed to be medical devices:

 

—devices for the control or support of conception;

 

—products specifically intended for the cleaning, disinfection or sterilisation of devices as referred to in Article 1(4) and of those referred to in the first paragraph of this point.

 

(2)‘accessory for a medical device’ means an article which, whilst not being itself a medical device, is intended by its manufacturer to be used together with one or several particular medical device(s) to specifically enable the medical device(s) to be used in accordance with its/their intended purpose(s) or to specifically and directly assist the medical functionality of the medical device(s) in terms of its/their intended purpose(s)。
