內(nèi)容概述: 本通知草案管制2015年4月24日關(guān)于廢物和拆解廢料管理的政府法令No.38/2015/ND-CP第3條第55條、第56條第3款、第61、62、63條及2014年12月19日關(guān)于允許作為生產(chǎn)材料進(jìn)口的拆解廢料清單的決議No.73/QD-TTg第5條規(guī)定的作為生產(chǎn)材料使用的拆解廢料進(jìn)口環(huán)境保護(hù)要求。 本通知草案管制為拆解而進(jìn)口的船舶的環(huán)境保護(hù)要求；2015年2月14日關(guān)于環(huán)境保護(hù)法條款執(zhí)行詳述的法令No.19/2015/ND-CP第22條第3、4、5款及第23和24條以及2014年11月26日關(guān)于獲得舊船進(jìn)口和拆解許可證的對象和條件的法令No.114/2014/ND-CP第17條第2款第d項(xiàng)和第3款規(guī)定的進(jìn)口和國產(chǎn)舊船拆解中的拆解機(jī)構(gòu)環(huán)境保護(hù)要求和環(huán)境保護(hù)計(jì)劃。 本通知草案適用于直接進(jìn)口外國拆解廢料作為生產(chǎn)材料使用的組織和個人；測試作為生產(chǎn)材料使用的進(jìn)口拆解廢料的組織和個人，被授權(quán)進(jìn)口外國拆解廢料作為生產(chǎn)材料使用的組織和個人；監(jiān)管機(jī)關(guān)，及作為生產(chǎn)材料使用的進(jìn)口拆解廢料相關(guān)管理單位。 本通知草案適用于舊船進(jìn)口和拆解相關(guān)監(jiān)管機(jī)關(guān)、組織和個人。

本通知草案管制為拆解而進(jìn)口的船舶的環(huán)境保護(hù)要求；2015年2月14日關(guān)于環(huán)境保護(hù)法條款執(zhí)行詳述的法令No.19/2015/ND-CP第22條第3、4、5款及第23和24條以及2014年11月26日關(guān)于獲得舊船進(jìn)口和拆解許可證的對象和條件的法令No.114/2014/ND-CP第17條第2款第d項(xiàng)和第3款規(guī)定的進(jìn)口和國產(chǎn)舊船拆解中的拆解機(jī)構(gòu)環(huán)境保護(hù)要求和環(huán)境保護(hù)計(jì)劃。
本通知草案適用于直接進(jìn)口外國拆解廢料作為生產(chǎn)材料使用的組織和個人；測試作為生產(chǎn)材料使用的進(jìn)口拆解廢料的組織和個人，被授權(quán)進(jìn)口外國拆解廢料作為生產(chǎn)材料使用的組織和個人；監(jiān)管機(jī)關(guān)，及作為生產(chǎn)材料使用的進(jìn)口拆解廢料相關(guān)管理單位。
本通知草案適用于舊船進(jìn)口和拆解相關(guān)監(jiān)管機(jī)關(guān)、組織和個人。

Description of content: This draft Circular regulates environment protection requirements to import of scraps to be used as production materials as specified in Article 55, Clause 3 Article 56, Article 61, Article 62, Article 63 Decree No.38/2015/ND-CP dated 24 April 2015 by Government regulating the management of waste and scraps and Article 5 Decision No.73/QD-TTg dated 19 December 2014 regulating list of scraps allowed to be imported for production materials.
This draft Circular regulates environment protection requirements to ships imported for scrapping; environment protection requirements to scrapping institutions and environment protection plan in scrapping each of used imported ships and domestic ships as specified in Clause 3, 4, 5 Article 22, Article 23 and Article 24 Decree No.19/2015/ND-CP dated 14 February 2015 detailing the implementation of a number of articles of Environment protection Law, Point d Clause 2, Clause 3 Article 17 Decree No.114/2014/ND-CP dated 26 November 2014 regulating objects and conditions to obtain license for used vessel importing and breaking.
This draft Circular applies to organizations and individuals who directly import foreign scraps for using as production materials; organizations and individuals who import scraps for testing to be used as production materials, organizations and individuals delegated for importing foreign scraps to be used by organizations and individuals as production materials; regulatory agencies, relevant units relating to management of scraps imported and used for production materials.
This draft Circular applies to regulatory agencies, organizations and individuals relating to importing and scrapping of used ships.
